N.Y.O. & W. Railway Trademark
Please be advised that the Ontario & Western Railway
Historical Society, Inc. is the owner of the trademark for the name
and logo of the New York, Ontario & Western Railway for use on
publications and printed matter, namely newsletters, tour guides,
calendars and archive reprints, all relating to railroad history; for
use on hats; for collectable toy trains, parts and accessories; for
promoting and conducting tradeshow exhibitions in the field of
railroad history, temporary retail stores set up on-site at trade shows
featuring books, publications, souvenirs, hats and memorabilia concerning
railroad history and promoting public awareness of railroad history and
railroad historical societies; for organizing and conducting
excursions along the remaining rights of way of historical railroads;
for conducting educational programs and exhibitions featuring slide
shows, presentations, artifacts and memorabilia in the field of
railroad history. This trademark is registered with the U. S. Patent
and Trademark Office.
As a result, the use of the New York, Ontario and Western Railway logo on and in the practice of the above mentioned subjects will require that a license be acquired from the Ontario & Western Railway Society, Inc., Box 713, Middletown, NY, 10940. We do not intend to levy burdensome requirements on the bona fide use of the New York, Ontario & Western Railway registered trademark.
You should immediately contact the Ontario & Western Railway Society, Inc. so that arrangements can be made for the issuance of the appropriate license for your product of service.
The Ontario & Western Railway Historical Society, Inc. intends to make the licensing process as painless as possible. However, the O&WRHS, Inc. will enforce it's Federal Trademark Provision to the fullest extent of the law. Thank you for your support and understanding.
